This privacy policy explains the when, how and why when it comes to processing of your personal information in connection with the mobile game Snowbreak: Containment Zone (the“Game”) and the website for the Game (“Website”), and sets out your choices and rights in relation to that information. Please read it carefully – it is important for you to understand how we collect and use your information, and how you can control it.

In this policy, “we,” “us,”  “our” and “Seasun ”  means 【SEASUN GAMES PTE. 1.  Parental and Guardian Consent

1.1 ANYONE UNDER THE AGE OF 13  (US)/16(EU,UK)OR THE MINIMUM AGE OTHERWISE DEFINED IN “COUNTRY / REGION SPECIFIC TERMS" UNDER THE APPLICABLE LAWS OF YOUR JURISDICTION (“MINIMUM AGE”) SHALL NOT USE 【SEASUN】 GAMES APPLICATIONS/SERVICE. WE WILL ALSO NOT KNOWINGLY COLLECT OR STORE ANY PERSONAL INFORMATION ABOUT CHILDREN UNDER THE AGE OF 13 (US)/)/16(EU,UK) WITHOUT PARENTAL PERMISSION.

1.2 IF YOU HAVE REACHED THE MINIMUM AGE BUT ARE UNDER THE AGE OF MAJORITY AS DEFINED UNDER THE APPLICABLE LAWS OF YOUR JURISDICTION (“MAJORITY AGE”), YOU MAY ONLY USE AND REGISTER A【SEASUN】GAMES APPLICATIONS/SERVICE ACCOUNT (“ACCOUNT”) THROUGH YOUR PARENT OR LEGAL GUARDIAN’S REPRESENTATION, AND YOUR PARENT OR LEGAL GUARDIAN HEREBY REPRESENTS YOU AND ACCEPTS THIS POLICY.

1.3 If you are a minor in your country or region, your use of Seasun Games Applications/service may be subject to further age restrictions, whether imposed by us or third-party vendors in connection with the provision of certain Services. You may be unable to use or only have limited access to those Services, such as, where applicable, some games with age restrictions, participating in rewards programs, top-up , without the assistance of your parent or legal guardian.

1.4 If you learn that a child under the Minimum Age has registered a Seasun Games Account or an Account of a minor under the Majority Age was not registered under proper supervision, representation or guardianship, you may alert us at【snowbreakcs@seasungames.com】. We will promptly investigate, take steps to remove such minor’s Account information from 【Seasun】Games applications/service and terminate the minor Account.

2. What data do we collect about you?

We collect personal information to the minimum scope necessary for the provision of the Game . The personal information we collect may be freely provided by the user, or, in case of usage data, collected automatically when using our Game and services.

Customers/players

2.1 For account registration:

When setting up and  signing into our product and services with[Amazing Seasun] account, we collect your account username, email address, password, and verification code. You may currently access the Services without establishing an account and log in as a guest,when you log in as guest,we may  your Guest log-in information, guest ID, Open ID,We use this information to create the account for your use of our services as you requested, to provide game login services, to store your game data and gameplay progress. We also collect your device ID and location information from your mobile operating system to assist you in creating the account, finding your device, and recommending you to a nearby server.

When signing into our product and services with a social login or your credentials from a third-party platform (for example, Facebook, Twitter,Google Play, Apple ID, Epic Games,) and we may collect the personal information that you have agreed to share via the social media site or third-party platform,such as your  user ID, nickname, profile picture, user token, Open ID.

The processing activity for this purpose is necessary for the performance of the contract between you and us.

2.2 While using our product and services

1) In order to enable you to buy the virtual game coins and use the payment service,If you choose to make purchase(s) with your Account, we may need to collect your payment data in order to process your purchase(s) and related activity, which may include your name, bank/debit/credit card number, card expiration date, billing address (country, city, postal code, address), and CVV. If you purchase through a third-party platform,we will collect your purchase records provided by a third-party platform,such as App Store or Google Play. .

The processing activity for this purpose is necessary for the performance of the contract between you and us.

2) In order to provide you with the community communication services with the game, we will collect your game level, score, chat log, chat content, virtual items of the game or the community.

The processing activity for this purpose is necessary for the performance of the contract between you and us.

3) In order to provide some location-based services such as forming a team with people nearby, we will collect your IP address, GPS.

The processing activity for this purpose is based on your consent. We will ask for your consent when you turn on this feature and you have the right to withdraw your consent at any time.

4) In order to improve our Services and correct bugs or errors that occur when you are playing the Game, we will collect relevant information including but not limited to your device information and network status.

The processing activity for this purpose is based on our legitimate interests and will not override your legal rights and interests.

5) in order to  prevent, detect and monitor any inappropriate conduct such as cheating, fraud and other toxic behaviors to the detriment of legitimate rights and interests of other users, our employees and company or any behaviors prohibited by the Terms of Service. We need to collect your device ID, Android ID,Device Serial Number,MAC address, IMEI data,device hardware information, list of installed APK and running apps,operating system version, network status, system logs, game data and purchase records provided by App Store or Google Play.

The processing activity for this purpose is necessary for compliance with the legal obligation we subject to.

6) to contact us for customer support, we need to collect personal information such as your username, e-mail address, mobile phone number, depending on your questions or requests. If you contact us via social media, we will collect your personal information that you have agreed to share via the social media site only to appropriately respond to your questions and requests.

The processing activity for this purpose is based on our legitimate interests and will not override your legal rights and interests.

Website users

If you use our website we may collect information regarding how you interact with the content on our website, which pages you visit etc.  We may do this using cookies and where we do so we do so in accordance with our cookies policy.  Information we collect may include:

● Internet protocol (IP) address;

● Unique  device identification numbers (such as your Media Access Control (MAC) address;

● Type of device, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website;

● Usage data including information about how you use our website, products and services;

2.3 For promotional offer

When taking part in a contest or survey organized by us , we collect your personal information that you have agreed to provide,such as your e-mail address, only to administer the contest or the survey, to send you promotional offers and/or for internal statistical purposes.

The processing activity for this purpose is based on your consent. You can choose whether or not to subscribe our promotions and you have the right to withdraw your consent at any time.

To improve our advertising strategy and to measure ad effectiveness, we may use  analytics service providers to analyze and keep track of our user behavior and to provide marketing insights. We provide the Mobile advertising identifiers, i.e. iOS IDFAs and Android Advertising IDs (“Mobile IDs”), device ID, system logs including you sign-in data, your usage data such as your in-app purchase records with Adjust based on your consent. If you wish to withdraw your consent, including with regard to the personalization of adverts and content, please go to Article 16.1  to withdraw your consent.

2.4  Access permission we may request

We may request the following access permission as listed in Appendix A from your mobile phone for the execution of related functions and services in a case where you  install and use the Game.

3. How we collect data about you

3.1 We will collect this data in a variety of ways depending on how we interact with you.

Direct interactions 

You may give us your identity, contact or other data by filling in online forms or by corresponding with us by post, phone, in-game, email or otherwise. This includes personal data you provide when you:

● Use our products or services;

● Create an account in one of our games or on our website;

● Interact with Customer Services;

● Subscribe to our mailing lists;

● Enter a competition, promotion or survey;

● Give us feedback;

 

Third parties or publicly available sources

We may receive personal data about you from various third parties and public sources as set out below:

● Third party account ID, game profile and user ID – for example from your account with Facebook, Google, or other which you may use to sign into your game account, leverage your social graph, or integrate with third party features (such as achievements).  Most data we receive from game publishers such as Microsoft will be processed by us, as a data processor (the publisher has a direct relationship with you and is the data controller and we use that data on their behalf).

● Technical data from the following parties:

●  analytics providers such as Google;

●  advertising networks such as Facebook; and

●  search data providers such as Google.

 

4. How we use your data

4.1 We use different data in different ways:

● To send you communications related to our services and games, answer your enquiries or deal with your complaints;

● Providing and managing our services including our games;

● Allowing you to participate in our website features;

● Account verification and clearance;

● Administering surveys and opinion polls;

● Managing competitions and/or promotions and your registration for the same;

● Technical and usage data/analytics to help us develop games that our customers want to play and to improve them and to detect cheating and activities that ruin the experience of players using our games, security risks, fraud and other unlawful activity;

● The provision of social features as part of our services;

● Customising your personal experience;

● To send you related data such as updates, security alerts and support messages;

● On-site and in-app advertising and promotion of our goods and services and those of our service providers and trusted third parties;

● Website, system administration and account verification;

● To moderate communications between players either automatically or manually;

● To answer or satisfy legal or regulatory requirements; and

● When you interact with third party social networking features to serve you with advertisements and engage with you on third party social networks (we encourage you to review the privacy notices/policies of these social networks to enable you to opt out of such activities).

5. Legal basis for processing

5.1 There are a number of different legal grounds for processing personal data.  Which one is applicable will depend on how we are using your data and for what purpose.  In the majority of cases this condition will be that:

● You have provided your consent to us using your personal data in that way (for example where you provide us with consent to send you marketing communications about our products and services); and/or

● Our use of your personal data is in our legitimate interest as a commercial organisation. Our legitimate interests include maintaining and administrating the services, providing the services to you, improving the content of our product and services, ensuring your account is adequately protected as well as compliance with any contractual, legal or regulatory obligations under any applicable law.

5.2 We generally do not collect or process any 'special categories' of personal data (including data regarding your health, religious or political beliefs, ethnic background, sexual life and sexual orientation). If this would apply, we will generally rely on obtaining specific consent from you at the time we collect the data unless there is a legal requirement or other justification for processing that data.

5.3 OUR WEBSITES AND OUR GAMES ARE NOT INTENDED FOR CHILDREN UNDER 13 YEARS OLD AND WE DO NOT KNOWINGLY COLLECT DATA RELATING TO CHILDREN UNDER 13.

6. To Whom We May Disclose or Transfer Your Data

6.1 We will not share or transfer any of your data to any third parties except as explicitly provided in this Policy. We will only share your data with third parties in the following circumstances:

(i) when approved or authorized by you or subject to the “Parental and Guardian Consent” section, your parent or legal guardian;

(ii) as required for administrative or judicial purposes, including any requirements of competent authorities, courts and regulatory bodies;

(iii) in any legal proceedings (including arbitrations) against you in which we aim to protect our legal rights;

(iv) where expressly allowed by the【Terms of Service】;

(v)in order to protect the interests of the Company, you or the public against harm; or

(vi) pursuant to the agreements made by you with any other third parties.

6.2 We may share your data with our corporate affiliates, group members, and the following third parties (“Details”), who will only use your data in accordance with this policy to facilitate the provision of Seasun Games applications/service to you or for other purposes as indicated below.

Seasun Games is a global company and has affiliates all over the world. In order to provide our Services, we will share your personal data with our affiliates  based on the respective legal basis and data processing agreements signed between us.

(ii)Data storage

We store some of your personal data using third-party data storage services, such as Google Cloud Platform (BigQuery) and Tencent Cloud.

(iii)Log-in

(vii) Law enforcement / legal obligation

(1)Anti-cheat and anti-fraud companies

we may share the information required for our detection, investigation and prevention of cheating in the Game and EULA violations only for the purposes of detection, investigation and prevention of cheating in the Game.  

(2)Public authorities and auditors

Some personal data shall be disclosed to public authorities, e.g., tax and customs authorities, auditors, and other competent parties in accordance with the applicable laws.

(viii) Sale or merger

A third party that acquires all or substantially all of us or our business. We will disclose information to a third party in the event that we sell or buy any business or undergo a merger, in which case we will disclose your data to the prospective buyer of such business. We will also disclose information to a third party if we sell, buy, merge or partner with other companies or businesses, or sell some or all of our assets. In such transactions, personal data may be among the transferred assets. You will be notified via email, in-app/in-game notice and/or notice on our website of any change in ownership or users of your personal data.

6.3 Except as otherwise provided in this Policy, we will not disclose any of the data collected from your use of Seasun Games applications/service to the public. If public disclosure is required by applicable laws and regulations, we will inform you of the purpose of the disclosure and the type of information disclosed.

7.  Data Storage and Retention

7.1 We will keep your data only for as long as your account is active or only for as needed to provide you the game services unless deleted in accordance with your request or as otherwise required by law. The locations of servers for the game services include:

(1)the United States;

(2)Singapore

7.2  We also have support, engineering, content moderation, and other functional teams located around the world to support Seasun Games applications/service provided to you. We have rigorous internal control measures in place to strictly limit data access to designated personnel only.Any access we may have to data will be done in a manner consistent with the laws of your country and region and in accordance with the principles of necessity and minimization.

7.3 We will retain your data for as long as necessary: (i) to achieve the purposes as set out in this Policy; (ii) as required by applicable laws and regulations, including any requirements to retain data for a certain period of time, taking into account the statute of limitations under applicable laws and regulations; (iii) for our legitimate and lawful purposes, including for our business, and provision of Seasun Games applications/service; and/or (iv) to defend against any actual, threatened or potential claims or disputes.

7.4 In some circumstances you can ask us to delete your data: see "Your rights" for further data.

7.5 Sometimes we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this data indefinitely without further notice to you.

7.6 If you opt out from marketing, we will retain your data to enable us to respect your wishes to not be contacted for marketing purposes.

8. International Data Transfer

8.1 We may transfer your game data and to other countries or regions solely for the purposes set out in this Policy, in accordance with this Policy and applicable laws and regulations. Data disclosure as referred to in this Policy may involve a transfer of your data to countries and regions that provide different levels of data protection. The aforementioned countries or regions do not have the same data protection laws as the EU and will not afford many of the rights conferred upon data subjects in the EU. Applicable legal and regulatory requirements are taken into consideration before any cross-border transfer of your data takes place and our policies are as follows:

8.2 We may share your data with our other group entities in other jurisdictions for internal, business and operational purposes in order to provide Seasun Games applications/service. We will ensure, by way of appropriate contractual guarantees which will also be in compliance with applicable laws and regulations, that all such entities with which we share your data maintain appropriate security measures to protect your data from unauthorized access or processing and will not share this your data with any third party unless you expressly agree otherwise.

8.3 In order to provide Seasun Games applications/service to you, we may need to transfer your data internationally to non-affiliated entities, which will only occur pursuant to the international transfer mechanisms available under applicable laws and regulations. If the country or region to which your data is being transferred does not provide an adequate level of protection to your personal data as required by applicable laws and regulations, your data may be transferred internationally based upon your prior consent, our exercise of a legal right, our compliance with a legal obligation, or the performance of a contract with you, among other mechanisms available under applicable laws and regulations.

9. Your rights Data Access and Management

9.1 Once you have completed your Account registration and put in place reasonable and necessary authentication measures, you can review, modify, and delete the data you have submitted to us by using the contact information provided in “Contact Information” of this Policy. In general, you can browse, modify, and delete your own information at any time, but you may not be able to modify certain initial registration information and verification information provided at the time of registration for security and identification purposes.

9.2 You may have the following rights to the extent applicable under local laws and regulations which you can exercise by using the contact information provided in this Policy:

(i) You have the right to be informed in a concise, transparent, intelligible and easily accessible form of the way in which your data is processed. You also have the right to obtain confirmation as to whether or not data concerning you is being processed, and, where that is the case, to access such Data and obtain a copy thereof.

(ii) You have the right to request rectification of your data. You also have the right to have incomplete data completed.

(iii) Where you have provided your consent, you may withdraw your consent. If you withdraw your consent, we may continue processing your data to the extent permitted by applicable laws and/or set out in this Policy.

(iv) You may also have other rights as described under the "Country / Region Specific Terms" section below or otherwise under the local laws.

9.3 We will verify your identity first before we can fulfill your request. We will respond to your request within the timeframe as required by local laws.

9.4 You may also be able to change your cookie settings as described in the section below to manage the data we collect using cookies.

9.5 You can prevent us from obtaining your data by suspending certain functions provided by our Services.

9.6 You can ask us to delete your Account, which is an irreversible process as you will not be able to access your Account upon deletion, and all data in relation to the Account will be deleted or de-identified, subject to any statutory retention requirements under applicable laws and regulations. If you wish to have your account deleted, you can contact us by using the contact information provided in “Contact Information” of this Policy or through the in-app setting “Account Protection – Account Deletion”.

9.7 Please note that these rights are not absolute – in some cases they will not apply to you, or to the particular use that we are making of your data, and there are exceptions (for example if we have to process the data to comply with our own legal obligations) but if that is the case we will let you know if you make a request that we believe we cannot comply with.

9.8 Any request from you for access to or a copy of your personal data must be in writing and we will endeavour to respond within a reasonable period and in any event within 15 days in compliance with data protection legislation. We will comply with our legal obligations as regards your rights as a data subject.

10. Marketing

10.1 If you are one of our customers or have otherwise agreed to be contacted for marketing purposes we may use your personal data to send you data about us and our services.  You can unsubscribe from receiving direct marketing at any time and details of how to unsubscribe will be included in any marketing communications we send you.  You also have the option of "unsubscribing" from our mailing list at any time thereby disabling any further such e-mail or other communication from being sent to you by emailing contact snowbreakcs@amazingseasun.com.

10.2 We will action any opt out request from you as soon as we can.

11. Data Security  and Protection

11.1  We will take appropriate technical and organizational measures to help protect and secure your data. We will endeavor to protect your data against unauthorized or unlawful processing, accidental loss, destruction, or damage through these measures, including:

(i)using encryption techniques;

(ii)establishing specialized systems and procedures, such as strictly limiting the scope of personnel with access to your data, and requiring those who have such access to comply with relevant confidentiality obligations; and

(iii)forming a specialized department in charge of data security. In the event of incidents such as data leakage or data or security breach, we will take timely measures to handle such incidents, and we will notify you promptly in an appropriate manner, including through messages or announcements.

11.2 We will endeavor to ensure that, by default, we only collect and process your data needed to provide Seasun Games applications/service. We also apply this principle to our data privacy and protection controls into our processing activities. This means that we will neither publish nor share your data by default.

11.3 While we are committed to protecting your data, no electronic data transmission or storage of data can be completely secure. If you do not agree to these risks and conditions, you must discontinue your use of Seasun Games applications/service.

12.1 Our websites may contain links to other sites, including via our social media buttons. While we try to link only to websites that share our high standards and respect for privacy, we are not responsible for the content, security, or privacy practices employed by other websites and a link does not constitute an endorsement of that website. Once you link to another website from our website you are subject to the terms and conditions of that website, including, but not limited to, its internet privacy policy and practices. 14. How we use cookies

14.1 In order to measure the effectiveness of our services, we may use cookies, which are small text files for added functionality or for tracking site usage. We may use cookies and/or authorize a third-party’s tracking-utility, from time to time, (a) to log your IP address in determining the path that users take on our sites and identifying repeated users of our sites, (b) to collect the websites or sources that linked or referred you to our services, and/or (c) to collect technical data about the devices and software you use to access our services, the operating system of your devices, and other similar technical data. 15. Changes to this policy

15.1 We may update, change or modify the terms hereof from time to time, and such changes shall form a part of this Policy.
